1. ELIGIBILITY: The Bradley Smoker's - Win a Smokin' Indian Contest is open only to individuals who are twenty-one (21) years of age or older at the time of entry. Employees of Bradley Smoker (USA) Inc, Bradley Smoker Inc and Bradley Technologies Canada Inc., and any of their affiliate companies, subsidiaries, agents, and advertising and promotional agencies, as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. Bradley Smoker's - Win a Smokin' Indian Sweepstakes is subject to all federal, provincial and municipal laws and regulations and is void where outlined in Section 8. and where prohibited by law.
2. SPONSOR: The Bradley Smoker's - Win a Smokin' Indian Sweepstakes is sponsored by Bradley Technologies Canada Inc. ("Sponsor").
3. AGREEMENT TO OFFICIAL RULES: Participation in the Bradley Smoker's - Win a Smokin' Indian Sweepstakes constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules and the decisions of Sponsor, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein in a timely manner.
4. ENTRY PERIOD: Bradley Smoker's - Win a Smokin' Indian Sweepstakes runs from now until October 10, 2010 at 11:59 pm PST. Entries received prior to or after the Entry Period will be disqualified.
5. ENTRY: You may enter by filling out the entry form located on the official website: www.bradley smoker.com/sweepstakes or by faxing a completed entry form to (604) 524-3839. Entry Ballots must be received no later than October 10, 2010 at 11:59 pm PST. There is a limit of one (1) entry per person, regardless of method of entry. Any use of agencies or robotic, repetitive, automatic, programmed, or similar entry methods will void all entries by that entrant. All entries become the property of Bradley Technologies Canada Inc. and will not be returned or acknowledged.
6. THE PRIZE: The prize for the “Bradley Smoker's – Win a Smokin' Indian Sweepstakes� is a 2003 Indian Spirit Motorcycle. The approximate retail value of the prize is $8,900.00 CDN (approx. $7,400.00 US). The prize may be substituted or altered in whole or in part for a prize of equal or greater value at the sole discretion of the Sponsor. Indian® is a trademark of Indian Motorcycle. Indian Motorcycle is not a sponsor of or affiliated with this promotion. Taxes, if any, related to the prizes are the responsibility of the individual winner. All other costs and expenses associated with each of the prizes, including without limitation accessories and additional items are the responsibility of the winner. If the winner does not wish to accept the prize as offered, the prize will be forfeited in its entirety.
7. DRAWING: On or about the week following October 11, 2010, the Sponsor will select one Grand Prize winner in a random drawing of all entries received. Sponsor's decisions are final. Odds of winning depend on the number of eligible entries received. Sponsor will attempt to notify the potential winner within fourteen (14) days of the drawing. If a potential winner cannot be contacted within seven (7) business days after the first attempt to contact him/her, the Sponsor shall have the right to disqualify that potential winner and select an alternate potential winner in his/her place at random from all entries received.
8. REQUIREMENTS OF THE POTENTIAL WINNER: Except where prohibited, the potential winner may be required to complete and return an affidavit of eligibility and liability/publicity release (the "Affidavit/Release") within ten (10) days of being notified, as well as answer a mathematical skill-testing question. If the potential winner fails to sign and return the Affidavit/Release or answer the mathematical question within the required period, Sponsor will select an alternate potential winner in his/her place at random from all entries received. Prize is nontransferable and non-refundable and must be accepted as awarded. No cash or other substitution may be made, except by Sponsor, who reserves the right to substitute a prize in whole or in part with another prize of equal or greater value if the prize is not available for any reason as determined by Sponsors in their sole discretion. Winner is responsible for all taxes associated with receipt of prize. Winner is also responsible for shipping costs associated with delivering the product from the Sponsor's address to the Winner's chosen destination.
   8A. FOR CANADIAN RESIDENTS ONLY: Before being declared a winner, the selected entrant must correctly answer, without assistance of any kind, whether mechanical or otherwise, a mathematical skill-testing question included on the declaration and release form. The Bradley Smoker's - Win a Smokin' Indian Sweepstakes is void in the Province of Quebec.
   8B. FOR U.S. RESIDENTS ONLY: Before being declared a winner, the selected entrant must correctly answer, without assistance of any kind, whether mechanical or otherwise, a mathematical skill-testing question included on the declaration and release form. The Bradley Smoker's - Win a Smokin' Indian Sweepstakes is void in State of Florida, New York and Rhode Island.
9. GENERAL CONDITIONS: The Sponsor reserves the right to cancel, suspend, and/or modify the Bradley Smoker's - Win a Smokin' Indian Sweepstakes if any fraud, virus, or other technical problem corrupts the administration, security, or proper play of the Bradley Smoker's - Win a Smokin' Indian Sweepstakes as determined by the Sponsor at their sole discretion. In such event, the Sponsor reserves the right to award the prize at random from among the eligible entries received up to the time of the impairment. The Sponsor reserves the right at their sole discretion to disqualify any individual they find to be tampering with the entry process or the operation of the Bradley Smoker's - Win a Smokin' Indian Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Bradley Smoker's - Win a Smokin' Indian Sweepstakes may be in violation of criminal and civil laws, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The Sponsors' failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute as to any online entry, the authorized account holder of the e-mail address used to enter will be deemed the entrant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address.
10. PUBLICITY: Except where prohibited, participation in the Bradley Smoker's - Win a Smokin' Indian Sweepstakes constitutes winner's consent to the Sponsors' use of winner's name, likeness, voice, opinions, biographical information and Province / State of residence for promotional purposes in any media without further payment or consideration.
11. PRIVACY: All information submitted by entrants as part of this Bradley Smoker's - Win a Smokin' Indian Sweepstakes will be treated in accordance with the Sponsors' Privacy Policies.
12. RELEASE: By receipt of a prize, winner agrees to release and hold harmless the Sponsor and their officers, directors, employees, and agents (the "Released Parties") from and against any claim or cause of action arising out of participation in the Bradley Smoker's - Win a Smokin' Indian Sweepstakes or receipt or use of any prize.
13. LIMITATIONS OF LIABILITY: The Released Parties are not responsible for: (a) any inaccurate information, whether caused by entrants or printing errors, (b) unauthorized human intervention in any part of the Bradley Smoker's - Win a Smokin' Indian Sweepstakes; (c) technical failures of any kind, including, but not limited to electronic malfunctioning of any network, hardware or software, (d) technical or human error which may occur in the administration of the Bradley Smoker's - Win a Smokin' Indian Sweepstakes or the processing of entries; (e) lost, delayed, misdirected, or undeliverable mail; or (f) any injury or damage to persons or property including, but not limited to, death, which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Bradley Smoker's - Win a Smokin' Indian Sweepstakes or receipt and use of any prize awarded to the Winner or their associates and or affiliates.
14. DISPUTES: Except where prohibited, entrant agrees that: (a) any and all disputes, claims and causes of action arising out of, or connected with, the Bradley Smoker's - Win a Smokin' Indian Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the Province of British Columbia, Canada; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering a Bradley Smoker's - Win a Smokin' Indian Sweepstakes; (c) entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant's rights and obligations, or the rights and obligations of the Sponsor in connection with the Bradley Smoker's - Win a Smokin' Indian Sweepstakes, shall be governed by, and construed in accordance with, the laws of British Columbia, Canada, without giving effect to any choice of law or conflict of law rules (whether of the Province of British Columbia, Canada or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than The Province of British Columbia, Canada.
